    Terms of service

    Last updated: 30 October 2026

    This translation is provided for information only. The French version is the only legally binding one.

    1. Seller

    These general terms and conditions of sale (terms) govern sales concluded between:

    S. Ventures Sàrl, operating the Birds&Co brand
    Chemin de la Roche 14
    1020 Renens, Switzerland
    UID number: CHE-198.150.907 VAT
    Email: info@birdsnco.ch
    Shop email: shopify@birdsnco.ch
    Phone: +41 21 539 46 47

    Hereinafter "Birds&Co" or "the seller", and any person who places an order in the online shop, hereinafter "the customer".

    2. Scope

    These terms apply to all orders placed in the Birds&Co online shop (birdsnco.ch and birdsnco.com). By placing an order, the customer confirms having read and accepted them. Purchases by municipalities, harbours and boatyards covered by a written offer are governed by that offer, with these terms applying otherwise.

    3. Products

    The products offered are those shown in the shop, while stocks last. Photos and descriptions are as accurate as possible. Slight differences in colour or appearance are normal: cork is a natural material and every platform is a little different.

    4. Prices

    Prices are in Swiss francs (CHF), including VAT at the rate in force on the day of the order. The price displayed when the order is placed is the only one that applies. Birds&Co may change its prices at any time, with no effect on orders already confirmed.

    Shipping costs are shown before the order is confirmed. Shipping is free on certain offers, when stated on the product page or in the cart. Any customs duties, import taxes and clearance fees outside Switzerland are paid by the customer.

    5. Order

    The customer chooses the products, enters a delivery address, then checks a summary of the order (products, quantities, prices, shipping costs). Errors can be corrected before confirming. The order is concluded when the customer clicks the payment button after accepting these terms. Birds&Co then confirms the order by email. The data recorded by Birds&Co serves as proof of the content and date of the order.

    Birds&Co may refuse or cancel an order in the event of an existing dispute with the customer, suspected fraud or an obvious pricing error. The customer is then refunded in full.

    6. Payment

    Payment in full is due when ordering. Payment is made by card (Visa, Mastercard, American Express) via Shopify Payments, or by the other payment methods offered at checkout. Card details are transmitted encrypted. Birds&Co never has access to the customer's card number.

    7. Pre-orders

    Some products are offered for pre-order, before the season's production starts, in Switzerland and in several European countries. In that case:

    • payment in full is due when ordering;
    • the pre-order can be cancelled free of charge, without giving a reason, up to and including 31 January 2027, by email to info@birdsnco.ch. The full refund is made within 14 days;
    • shipping starts from the end of February 2027, in order of purchase;
    • for platforms installed by Birds&Co (offers for businesses, harbours and municipalities, sponsorships), installation takes place between February and March 2027, depending on the weather;
    • after 31 January 2027, the order can no longer be cancelled, but the right of return described in article 9 still applies from receipt of the product;
    • if delivery is more than 30 days later than the announced date, the customer may cancel the order and receive a full refund;
    • if Birds&Co ultimately cannot deliver to the customer's country, the order is cancelled and refunded in full.

    Sponsorships (platforms given to a harbour, municipality or association in the customer's name) are not refundable.

    8. Delivery

    Products are delivered to the address given by the customer when ordering, in the countries offered in the shop (Switzerland for products in stock, and according to the countries open for pre-orders). If Birds&Co finds afterwards that it cannot deliver to the address given, the order is cancelled and refunded in full. Delivery times are given as an indication. Products in stock are generally shipped within 5 working days. If the delay exceeds 30 days from the order (or from the announced date for a pre-order), the customer may withdraw from the sale and be refunded.

    A tracking number is sent by email when the order ships. If the customer is absent, the carrier leaves a notice and the parcel can be collected at the pickup point indicated. The customer checks the parcel on receipt and reports any transport damage to info@birdsnco.ch within 7 days, with photos.

    9. Returns and refunds

    Swiss law provides no right of withdrawal for online purchases. Birds&Co nevertheless offers, on its own initiative, a 14-day right of return from receipt of the order, provided the product is sent back unused, in good condition and in its original packaging.

    To use it, the customer writes to info@birdsnco.ch with the order number, then sends the parcel back to the address given by Birds&Co. Return costs are paid by the customer. The price of the products is refunded within 14 days of receipt of the return, using the payment method used for the order.

    For customers resident in the European Union, the 14-day right of withdrawal under the law of their country of residence is reserved. Return costs remain their responsibility.

    A used, damaged or incomplete product cannot be taken back, except for a defect covered by the warranty.

    10. Warranty

    Products are covered by the Swiss statutory warranty for defects (art. 197 et seq. of the Swiss Code of Obligations) for two years from delivery. It covers manufacturing or material defects present at delivery.

    The customer checks the product on receipt and reports any defect as soon as it is noticed, by email to info@birdsnco.ch, with photos and the order number.

    If a defect is confirmed, Birds&Co repairs, replaces or refunds the product, whichever is most appropriate.

    The warranty does not cover normal wear, or damage caused by misuse, unsuitable fastening, loss, theft or force majeure (storm, boating accident).

    11. Use of the product and wild birds

    Birds&Co platforms are designed to give water birds a place to nest. The birds, whether great crested grebes or Eurasian coots, are wild and protected animals: they choose freely where they nest. Birds&Co therefore cannot guarantee that a bird will settle on the platform, or when.

    The customer remains responsible for complying with the law, in particular the Swiss Federal Hunting Act on the protection of wild mammals and birds (JSG): it is forbidden to touch, move or destroy an occupied nest during the nesting season. The customer follows the installation advice supplied with the product and chooses a spot suited to the harbour and the boat.

    12. End-of-life take-back

    Birds&Co takes back platforms at the end of their life. The customer can write to info@birdsnco.ch to arrange the return, with the original packaging if possible.

    13. Liability

    To the extent permitted by law, the liability of Birds&Co is limited to direct damage and, except in cases of gross negligence or intent, does not exceed the price paid for the product concerned. Birds&Co is not liable for damage related to the internet (data loss, intrusion, viruses, service interruption) or for use of the product not in line with its purpose. Mandatory consumer rights are reserved.

    14. Intellectual property

    The texts, photos, videos, logos and other elements of the shop belong to S. Ventures Sàrl or its partners. Any reproduction or use, even partial, requires the prior written consent of Birds&Co.

    15. Personal data

    Customer data is processed in accordance with our privacy policy.

    16. Applicable law and jurisdiction

    These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention). The place of jurisdiction is Lausanne, subject to the mandatory rules on jurisdiction for consumers.

    These terms are written in French. The German and English translations are provided for information only. In case of any difference, only the French version is binding.

    17. Changes to the terms

    Birds&Co may change these terms at any time. The terms applicable to an order are those in force on the day it is placed.
