Hereinafter "Birds&Co" or "we".

2. Legal framework

This policy complies with the Swiss Federal Act on Data Protection (FADP) and, for people in the European Union, the General Data Protection Regulation (GDPR).

3. The data we collect

Orders and customer account: surname, first name, delivery and billing address, email, phone number (if you give it), content and history of orders. Payment data is processed by Shopify Payments: we neither see nor store your card number.

Newsletter and prize draws: first name, email, and a record of your consent. For prize draws, the details needed to contact you and send you the prize.

Exchanges with us: emails, contact forms, answers to our satisfaction surveys, phone calls.

Customer reviews: rating, text, and a photo if you choose to add one.

Requests from organisations (municipalities, harbours, businesses): name of the organisation, contact details, information about the project.

Technical data: IP address, device and browser type, pages visited, where the visit came from, measured by cookies and similar tools (see article 9).

4. Why we use it

to take, process, ship and invoice your orders;
to contact you about your order and provide after-sales service;
to send you our newsletter, if you have subscribed;
to answer your requests;
to measure site traffic and improve the shop and our products;
to show and measure our ads, if you have accepted marketing cookies;
to meet our legal, accounting and tax obligations.

5. On what basis

Performance of the contract: order processing and after-sales service;
Consent: newsletter, prize draws, analytics and advertising cookies;
Legitimate interest: shop security, fraud prevention, improving our services, managing customer relations;
Legal obligation: keeping accounting records.

6. Who we share it with

We never sell your data. It may be passed to service providers working for us, only for what we need:

Shopify (Shopify Inc., Canada, and Shopify International Limited, Ireland): shop hosting, order management and card payment (Shopify Payments);
carriers and postal services: delivering your parcel;
HubSpot: customer relations and email management;
Judge.me: collecting and displaying customer reviews;
Tally: forms and surveys;
Google (Tag Manager, Analytics) and Meta (Facebook, Instagram): audience measurement and advertising, if you have accepted the corresponding cookies;
accountants and authorities: only when required by law or for accounting.

7. How long

order and billing data: 10 years (Swiss accounting obligation);
newsletter: until you unsubscribe;
requests from organisations and customer exchanges: 3 years after the last contact;
customer reviews: until you ask for their removal;
technical data and cookies: 12 months at most.

8. Your rights

You can ask at any time for:

access to your data;
its correction;
its deletion;
restriction of processing, or to object to it;
a copy in a structured format (portability);
withdrawal of your consent, with no effect on what was done before.

Write to us at info@birdsnco.ch. We reply within 30 days and may ask for an ID to check that the request really comes from you. You can also unsubscribe from the newsletter in one click from any email.

9. Cookies and measurement tools

The shop uses strictly necessary cookies (cart, session, security, payment). With your consent, it also uses audience measurement cookies (Google) and advertising cookies (Meta pixel), which tell us what works and help avoid ads that are not relevant to you. You choose via the cookie banner, and you can change your mind at any time in your browser settings or by deleting the site's cookies.

10. Transfers abroad

Some providers (Shopify, Google, Meta, HubSpot) process data outside Switzerland, in particular in Canada and the United States. In that case, we make sure appropriate safeguards are in place, such as standard contractual clauses or certification under the Swiss-U.S. Data Privacy Framework.

11. Security

Connections to the shop are encrypted (SSL/TLS), access to data is limited to the people who need it, and payments go through PCI DSS certified providers. No measure guarantees absolute security, but we do what is needed to limit the risks.

12. Changes

We may update this policy, for example if we change a tool. The online version applies, with its update date at the top of the page.
